How Long Do You Have to File a Personal Injury Lawsuit in Texas?

If you have been injured in an accident caused by someone else’s negligence, you may be entitled to compensation through a personal injury lawsuit. However, Texas law imposes strict deadlines on when you can file a claim, known as the statute of limitations. Missing this deadline can mean losing your right to pursue damages altogether.


Texas Statute of Limitations for Personal Injury Cases


In Texas, the statute of limitations for most personal injury lawsuits is two years from the date of the injury. This means you typically have two years to file your claim in court. Whether the injury arose from a car accident, slip and fall, or another type of negligence, the two-year clock usually starts ticking on the day of the incident.


Exceptions to the Two-Year Rule


While two years is the general rule, some circumstances may extend or shorten this time frame:


  • Minors – If the injured person is under 18, the statute of limitations may be tolled (paused) until they reach adulthood.
  • Discovery Rule – If the injury was not immediately apparent, the time limit may begin when the injury was discovered or reasonably should have been discovered.
  • Government Defendants – Claims against government entities often require notice within six months of the injury, a much shorter deadline.
